what landlords and tenants wish to know — idealista/information

Italy Highlights

Rental insurance is not generally compulsory in Italy, but it can become a condition of a tenancy if the landlord and tenant include it in their rental contract.

For foreign residents moving to Italy, the distinction matters: policies can offer protection against unpaid rent, accidental property damage, legal disputes and, in some cases, short-term difficulty paying rent.

Rental insurance is optional under Italian law

Italian rental rules do not impose a general obligation to take out rental insurance.

Insurance is therefore optional unless a landlord and tenant make it a binding clause in their agreement. The cover available differs according to the policy selected and the premium agreed with the insurer.

  • Landlord policies can protect rental income and the property itself.
  • Tenant policies may cover civil liability, personal belongings and, in specific cases, rent payments during verified financial difficulty.

Landlord insurance in Italy and missed rent cover

Landlord policies, also referred to as affitto sicuro, can be designed to cover unpaid rent, damage to the property and related legal expenses.

Depending on the policy terms, a landlord may receive reimbursement for a defined number of missed monthly payments. This may apply before or after eviction validation. Policies can also include property-damage cover, legal assistance in disputes and checks on a prospective tenant’s solvency.

Landlord Rental Protection, an insurance policy distributed by idealista, is an example. It includes:

  • Cover for up to nine unpaid monthly rent payments in the event of tenant arrears
  • Reimbursement of legal costs required for eviction proceedings
  • Legal protection for the landlord in criminal proceedings
  • Cover for damage to the property and its contents
  • Protection for ownership disputes involving neighbours, easements, boundaries and adverse possession

Tenant insurance in Italy: liability and belongings

Under Article 1588 of the Italian Civil Code, a tenant has legal custody of the rented property. The tenant is directly responsible for deterioration, damage and other issues arising during the lease, unless they can prove otherwise.

Tenant insurance can include:

  • Civil liability for unintentional damage to the home or third parties, including damage caused by plumbing faults
  • Protection for the tenant’s personal belongings and furnishings against unexpected events
  • Support with rent payments during verified financial difficulty, available only under certain policies

How much does rental insurance cost in Italy?

The cost of landlord cover depends on factors including the annual rent, the tenancy duration, the property’s location and the monthly rent amount insured.

For a monthly rent of €1,500, you can estimate that annual landlord insurance can cost between €350 and €1,800, depending on the selected options.

Tenant policies are generally less expensive. Their price is mainly affected by the property’s size, the chosen cover limits and optional guarantees.

Standard civil liability and contents cover is estimated at €80 to €200 per year. The premium can increase where rent-payment protection is added, when available.
